For those that find themselves with past-due reports and delinquent taxes or fees, there is some good news. Starting June 12th through August 17th this year, the Texas Comptroller of Public Accounts will waive penalties and interest for qualifying businesses that file delinquent tax reports and pay all taxes due, or amend reports that underreported taxes and pay the taxes due. Reports originally due before April 1, 2012, are eligible for this limited amnesty.

Given its name, The Fresh Start Texas Taxpayer Amnesty Program allows businesses to be given a “fresh start” by filing past due reports or amending reports, without suffering any negative consequence.

The amnesty is available for all state and local taxes and fees administered by the Comptroller's office, but note that the Unclaimed Property program is not a part of tax amnesty.

The Fresh Start Amnesty only applies to those that did not file a tax report, or underreported tax on a previously filed report, or to those that don’t have a permit to report and remit Texas taxes. However, the Comptroller has made it clear that this amnesty does not apply to property taxes because those are collected by separate Texas entities, such as school districts and cities.
